Licence Condition
What are Licence Conditions?
When a prisoner is released from custody, they are typically released on licence. A licence sets out the conditions under which a person is permitted to live in the community. Breach of those conditions can result in recall to prison.
Standard conditions apply to all licences, however additional conditions can also be imposed for example: restrictions on where you can live; who you can associate with or what areas you can enter.
Licence conditions must be necessary and proportionate to the risk that you are assessed as presenting. Some conditions may be considered excessive where a condition goes further than what is required to manage your risk. In these circumstances, the conditions may be challenged.
Conditions that prevent clients from living with family, attending work, participating in their community without good reason can have a devastating impact on their rehabilitation and on their ability to reintegrate successfully.
How we can help
We understand how stressful and frustrating it can be to feel that licence conditions are preventing someone from living a normal life after release.
Our team can review the conditions attached to a client’s licence and advise them whether they are open to challenge. We will consider the risk assessment and any reports that have been used to justify the conditions, and where we believe a condition is disproportionate or unjustified we will make representations on their behalf to the Probation Service or the Parole Board as appropriate.
Funding and Legal Aid
Depending on a sentence type, legal aid may be available. If legal aid is not available in your case, we offer competitive private rates.
