Successful Application for the Return of Our Client’s Driving Licence

We represented a client who was disqualified from driving for a total of 5 years and 6 months following a conviction for causing serious injury by dangerous driving.

Under Section 42 of the 1988 Offenders Act a person disqualified from driving may apply for the removal of a disqualification:

(a)if the disqualification is for less than four years, when two years from the date on which it was imposed have expired,

(b)if the disqualification is for less than 10 years but not less than four years, when half the period of disqualification has expired, or

(c)in any other cases, i.e. 10 years or more or for “life”, when five years have expired from the date of disqualification.

We lodged an application more than a year before the end of the disqualification period and were able to provide evidence showing that our client had not committed any further offences and had potential employment which was dependant on him obtaining his driving licence.

After hearing submissions by Nadia Chbat of 4 Kings’ Bench Walk the Court agreed to end the disqualification period with immediate effect and our client was able to apply and take the extended driving test and obtain a full driving licence.
