Minimum 5 Year Custodial Sentence Not Imposed
Paul Gilmartin represented a client charged with possessing a prohibited firearm, contrary to section 5(1)(af) of the Firearms Act 1968 among other offences.
The charge of possessing a prohibited firearm is subjected to a minimum sentence of 5 years custody unless there are exceptional reasons not to impose the minimum.
Our client pleaded guilty on the day of trial and had a Newton hearing. The Judge did not accept our basis of plea but did grant our special reasons application resulting in our client receiving a suspended sentence order.
