No Evidence Offered in Beth Vaughan’s Trial
Beth Vaughan represented a client charged with allegations of harassment and threatening communication. These matters revolved around the defendant sending various messages from a fake social media account.
The defence in this case was that the defendant could not form the necessary mens rea for both offences.
A psychologist was instructed who assisted our defence and was due to give evidence at the trial. An intermediary also attended the trial in order to assist both the defendant and complainant in giving evidence.
At the trial the Prosecution applied to adjourn the trial due to them not being trial ready. Beth opposed this application on the basis of the mental stress and trauma that the proceedings had already had on the defendant.
The District Judge did not grant the Prosecution’s application for an adjournment and ordered that they proceed without delay. As a result of this the Prosecution offered no evidence in relation to both charges.
